HTHA Home Electrification terms and conditions

1.1 These terms and conditions are between you and Home Trades Hub Australia, ABN 98 643 191 673 (HTHA).

1.2 The HTHA Home Electrification service (Service) consists of the following steps:

a)    Proposal;

b)    Quote and Inspection; 

c)    Installation.

1.3 HTHA operates several businesses relevant to the Service, including:

a)    RACV Solar Pty Ltd; 

b)    Club Home Response Pty Ltd; 

c)     Rapid Building Inspections Pty Ltd.

(the HTHA Businesses)

1.4 These terms and conditions are effective as of 1 August 2025.

1.5 You agree to these Terms and Conditions when you submit a free proposal request or submit a "Request a Quote" request. 

2.1 HTHA has engaged a third party, SpendWatt Pty Ltd ABN 38 150 704 475 to prepare your proposal (Proposal) for electric appliance(s) upgrades (a Project) through the quote platform (Platform).

2.2 The Platform is only intended to provide tools to assist in the creation and presentation of your Proposal.

2.3 You acknowledge and agree that:

a) your Proposal is based upon and generated from data which may be uploaded, generated, compiled, arranged or developed on the Platform; 

b) your Proposal contains estimates only, and may not take into account all considerations and factors applicable to a Project; 

c) any visualisations included in Proposals are indicative only;

d) any financial forecasts, cost savings or energy consumption savings included in the Proposals are indicative only; 

e) you should not rely on the Proposal and/or the recommendations set out in the Proposal without regard to other considerations, professional advice or further due diligence; 

f) HTHA makes no representation or guarantee that the Proposal alone is accurate, reliable or complete or that You will achieve particular results by relying on the Proposal alone; without limiting these Terms, if You are an Administrator or Operator, in preparing Proposals through the SpendWatt Platform or responding to Proposals prepared through the SpendWatt Platform.

2.4 Your Proposal is distributed to you by Rapid Building Inspections Pty Ltd (RBI).  

3.1 The Service is only available to owner-occupiers and rental providers for owned investment properties. Properties must be located in Victoria (the Property).   

3.2 Following receipt of your Proposal, you can elect to "Request a Quote."

3.3 HTHA will contact you via the contact details you provided with your Proposal and may organise an attendance on your property by a tradesperson to complete an inspection and further consultation in relation to your Project (the Inspection).

3.4 Your Inspection is designed to verify any calculations on which the Proposal is based or has been prepared, and to ensure that HTHA is able to supply the products or services listed in a Proposal in the manner described therein and for the amounts set out therein. Your Inspection does not include provision for any urgent repairs or replacement parts. Urgent repairs or replacement parts should be directed to RACV Trades on 1300 754 097.

3.5 Your Inspection will be delivered to you by HTHA’s wholly owned subsidiary, Club Home Response Pty Ltd (ABN 82 168 839 487), trading as RACV Trades, or an RACV Trades subcontractor or contracted business (RACV Trades).

3.6 Within two business days of your Inspection being completed, you will receive a personalised proposal and quote (Quote) delivered to your nominated email address.

3.7 Where your Project includes:

a) solar, battery, EV charging, heat pumps and cook tops, your Quote will be provided by RACV Solar Pty Ltd (RACV Solar) and subsequent communications and your customer contract will be sent from RACV Solar.

b) heating and cooling services, your Quote will be provided by Accel Air Pty Ltd (Accel Air) and subsequent communications and your customer contract will be sent from Accel Air.

3.8 If you proceed with your Quote, you will be contacted to schedule your Project and arrange for a tradesperson to attend your property on the chosen day(s) to complete the installation of your Project.

4.1 You may call RACV Trades to cancel or change the date and time of your inspection or installation by contacting RACV Trades on 1300 754 097.

5.1 You share a responsibility to ensure that your Property is at all times a safe working environment for the tradesperson completing the Inspection. This includes, but is not limited to, ensuring you identify and provide the tradesperson with any information regarding risks to health and safety present at or on your Property, such as the presence of asbestos or hazardous substances, the presence of dangerous animals or any infections, contagions or infected or contagious persons.

5.2 If the tradesperson encounters asbestos or any other hazardous substances while carrying out your Inspection, the tradesperson may attempt to make the area safe, including restricting access to the relevant area (if required). You acknowledge and agree that you will comply with any instructions provided by the tradesperson regarding the area where the asbestos or hazardous substance is located, including during the period after the tradesperson leaves the Property.

5.3 You must notify your tradesperson in advance of any risks to health and safety, including any unsafe conditions at your Property that may affect the performance of your Inspection. RACV Trades or RACV Trades contracted business reserves the right to refuse to perform the inspection without any liability to you, if in the tradesperson’s reasonable opinion, your Property is not a safe working environment, until such time as the Property has been made safe at your cost (including professional cleaning or removal of all asbestos product from that part of the Property where asbestos is present).

5.4 RACV Trades reserves the right to reschedule or refuse to perform the Inspection, if in the reasonable opinion of the tradesperson, performance of such works would breach RACV Trades obligations to its employees, partners or contractors under applicable occupational health and safety legislation (for example, during wet weather or extreme heat).

5.5 RACV Trades reserve the right to refuse to perform the Inspection if you (or any person associated with you) is acting or behaving in a manner that the tradesperson considers is inappropriate, improper, hostile, threatening, abusive or dangerous (whether at your Property or by phone).

6.1 When you submit a quote request, HTHA collects personal information including your name, email address, property address, types of home appliances and details of your gas and electricity bills.

6.2 HTHA collects personal information from you for the purposes of:

  • Generating and supplying a Proposal;
  • Conducting an onsite Inspection (if required) and preparing and supplying a Quote;
  • Communicating with you about your Proposal, Inspection and Quote and services related to your Proposal, Inspection and Quote, including communicating with you using any contact details provided by you, including post, phone, email and SMS;
  • Disclosing information (including personal information) to third parties for the purpose of preparing a Proposal, completing an Inspection and installations of appliance(s), such as the tradesperson who will attend your residential property;
  • With your consent, using personal information collected in accordance with these terms and conditions to promote products and services to you, or obtain feedback from you for research and product improvement purposes; and
  • Obtaining feedback from you about your experience with our services;
  • Business analysis and quality assurance purposes, including generating customer insights and conducting research to improve our services and products.

6.3 HTHA may also use and collect non-personal aggregate information, such as statistical and other anonymous information (including location information) for research purposes to help us enhance and improve our services and to develop current and future services and functionality; and for other purposes related to our business.

6.4 If you do not provide HTHA with the information we need, or if you provide HTHA with incorrect or incomplete information, then we may not be able to provide you with the electrification services or any inspections and quotes we share with you may not be suitable or appropriate for your circumstances.

6.5 We use a service provider, SpendWatt Pty Ltd, to prepare and send to you electrification reports which summarise available options and estimates of the potential costs of implementing the options and associated energy savings. SpendWatt Pty Ltd owns the proprietary software to prepare the quote.

6.6 When you submit a quote request, your personal information will be disclosed to our trade service partners and tradespeople who will either attend your property or contact you by using any contact details provided by you, to complete an inspection and if you proceed with the quote, the installation of appliance(s) at your property. We have taken steps to ensure acceptable security arrangements are in place to protect your information.

6.7 A copy of the SpendWatt Pty Ltd Privacy Policy is available at https://spendwatt.com/privacy-policy.

6.8 We will also share your personal information with our parent company, Royal Automobile Club of Victoria (RACV) Ltd, who, if you have given your consent, will use the information to send follow up marketing communications. RACV may also use this information for the purposes described in this notice. If you do not wish to receive any marketing material from RACV, you can withdraw your consent on 13 15 60 or by using the unsubscribe function if you have received marketing material electronically.

6.9 A copy of the RACV Privacy Charter is available at https://racv.com.au/privacy.

6.10 We may also disclose your personal information to law enforcement agencies, lawyers, advisers, auditors, and the agent of any of these, as may be necessary to manage our business activities and comply with our legal and regulatory obligations.

6.11 We rely on software to run our business. This means that personal information may pass through or be stored in technology hubs or on servers located outside of Australia. Where this occurs, we retain effective control over your personal information.

6.12 HTHA may use your personal information to tell you about other products and services, discounts, special offers, competitions, and invitations to special events. If you do not wish to receive any marketing material from RACV, you can withdraw your consent by contacting us on 13 15 60 or by using the unsubscribe function if you have received marketing material electronically.

6.13 HTHA’s Privacy Policy has up-to-date information about how you can get access to, and ask us to correct, your personal information. It also explains how to lodge a complaint if you are not happy with how we have managed your personal information. You can find it at https://www.htha.com.au/privacy-policy.

7.1 Businesses make no warranty or representation about the suitability or effectiveness of any information, suggestion, or recommendation in the Quote. HTHA and each of the HTHA Businesses and their related companies and business partners, may be able to provide goods and/or services to assist you to implement the information, suggestions or recommendations in the Proposal. You are under no obligation to request or accept any Proposal or Quote from HTHA or any HTHA Business or their related companies and business partners to perform any work, enhancement or change mentioned, suggested, or recommended in the Proposal. The Proposal does not constitute financial advice. Neither HTHA nor any HTHA Business guarantees that the Proposal is free from errors.

7.2 Nothing in this Agreement excludes any liability implied or imposed by any laws (including the Australian Consumer Law) that cannot be lawfully excluded or limited. Where HTHA can limit its liability under the Australian Consumer Law, HTHA limits such liability to the following (at HTHA’s option) for:  

a) goods, the replacement of the goods or the supply of equivalent goods, the repair of goods, the payment of the cost of replacing the goods or of acquiring equivalent goods; or

b) services, the supplying of the services again, or the payment of the cost of having the services supplied again.

7.3 Subject to section 15, if HTHA is found to be liable to you in connection with this Agreement, the liability of any of HTHA, an HTHA Business, its servants or agents is limited to a sum not exceeding $10,000 (which shall include legal costs) in respect of the aggregate of all claims during any consecutive period of 12 months.

7.4 To the extent permitted by law, HTHA will not be liable to any person for any Consequential Loss in connection with this Agreement, howsoever arising. Consequential Loss means any loss of income, loss of revenue, loss of profit, loss of financial opportunity, loss of business or loss of business opportunity, loss of goodwill, loss of use or loss of production or financing costs, whether present or future, fixed or unascertained, actual or contingent. 

7.5 HTHA shall not be liable for any default or failure to perform its obligations under this Agreement where the failure or default arises from acts of God, wars, acts of terrorism, accidents, fires, explosions, earthquakes, lightning strikes, floods, pandemics, strikes, industry disputes, shortage of parts, any action by you including any interference with misuse, damage or abuse to any parts or material by you and/or another person, any failure by you to perform your obligations under this Agreement or any other circumstance beyond the control of HTHA.

8.1 All intellectual property rights in information, trademarks, logos, business processes, data and materials including without limitation all software, tools, know-how, or processes, used in relation to the Service shall remain HTHA and its related entities and licensors’ exclusive intellectual property. You acknowledge and agree that you shall not acquire any rights, title or interest in or to any of our intellectual property rights.

9.1 HTHA may subcontract the performance of all or any of its obligations under this Agreement to any person or firm without giving notice to you.

9.2 HTHA may use one or more subcontractors, suppliers, vendors or licensors to provide the Services. To the extent permitted by law, the limitations of liability in sections 19 to 23 of this Agreement shall apply to the work, products or services that our subcontractors, suppliers, vendors or licensors provide, and shall apply to them and protect such subcontractors, suppliers, vendors or licensors in the same manner as it applies to and protects HTHA.

10.1 Where HTHA alters these terms and conditions, HTHA will use reasonable endeavours to advise you of any such change by posting notification of changes on the following website: https://www.racv.com.au/home/trades/terms-conditions.html.

11.1 You may not assign, transfer or otherwise deal with the rights under this Agreement without the prior written consent of HTHA.

11.2 HTHA may assign, novate or otherwise deal with its rights and obligations under this Agreement in favour of a related entity of HTHA or RACV.

11.3 These terms are governed by, and construed in accordance with, the laws of Victoria, Australia.
